1. Acceptance of Terms
By downloading, installing, and using any Punchline Foundry application ("App" or "Service"), you agree to be bound by these Terms of Service. These Terms apply to: Jokesmith and Gigsmith.
Punchline Foundry is a division of Fouled Anchor Safety LLC. If you do not agree to these Terms, you may not use our Apps.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal and professional use. You may not reverse engineer, modify, rent, or use the Apps to create competing products.
3. User-Generated Content
You retain ownership of all content you create within our Apps (jokes, setlists, performance recordings, gig data, venue notes, contacts, financial records, etc.). By using the Apps, you grant us a limited license to store, process, back up, and synchronize your content to provide the service.
Performance recordings processed by Jokesmith's ML features remain on your device. Scene lines you speak or type in Riffsmith are yours as well; in Enhanced mode they are transmitted for processing solely to generate your partner's next line and your coaching report. We do not claim any rights to your comedy material and we do not use it to train models.

5. AI Features & Generated Content
Riffsmith's scene partner and coaching reports, and Jokesmith's StageIntel predictions, are generated automatically. Treat them as practice feedback and estimates, not as professional instruction, coaching credentials, or any guarantee of how material will perform in front of a real audience.
5.1 Cloud AI Requires Your Permission
Riffsmith does not send any scene content to a third-party AI service until you explicitly permit it. Before your first interactive scene, the app presents an AI Data Sharing screen setting out what is sent, who receives it, and how it is used, and you choose whether to allow cloud AI or continue without it. Declining keeps local scripted practice and supported on-device features available.
When you allow cloud AI, scene text, scene setup and preferences, and coaching context are transmitted to Anthropic, PBC through a proxy hosted by Render Services, Inc., and — only when Premium Voice is enabled — AI-generated partner dialogue is sent to Inworld AI for speech synthesis. Microphone audio is never transmitted to these providers. Full detail is in our Privacy Policy.
You may review or revoke this permission at any time at Settings → Privacy → AI Data Sharing. Revoking it stops all cloud AI requests immediately. Availability of AI features, the specific models used, and generation limits may change over time, and daily scene and coaching-report limits apply by tier.
6. Payment, Pricing & Subscriptions
All transactions are processed through Apple's App Store; we never see or handle your payment details. Subscriptions automatically renew unless cancelled, and you can cancel anytime through App Store settings. Jokesmith and Gigsmith offer a free tier with paid upgrades that unlock iCloud sync and advanced analytics. Riffsmith is free to start and offers Pro and Elite tiers, which raise daily scored-scene and coaching-report limits and unlock additional modes and voices; free and paid allowances are stated in the app and may be adjusted for future purchases. Veteran and military discounts are provided on an honor-system basis. Refund requests are governed by Apple's App Store policies.
7. Warranty Disclaimer
THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. ML-powered features (laugh detection, StageIntel predictions) provide estimates only and should not be relied upon as definitive measures of performance quality.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOULED ANCHOR SAFETY LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount you paid for the App in the past 12 months, or $100, whichever is less.
9. Venue Database (Gigsmith)
Venue information in Gigsmith's database is provided for informational purposes and may not be current. We are not responsible for the accuracy of venue details, pay rates, or contact information. User-submitted venue data is subject to review.
10. Termination
We may terminate your account if you violate these Terms or engage in fraudulent or illegal activity. Upon termination, your right to use the Apps ceases immediately.
11. Governing Law
These Terms are governed by the laws of the United States and applicable state law.
